However, compared with European and American countries, there are still some problems, such as small scale of enterprises, weak innovation and R &D ability, lack of core technology and superior products. It is mainly manifested in the following three problems

1. The innovation ability of domestic enterprises needs to be strengthened

Although China pays more and more attention to the protection of TCM extract related technologies, the total number of related patents is the largest, but the distribution of applicants is relatively scattered, lack of large companies or research institutions, and the number of high-quality patent applications is obviously weaker than that of the United States, Japan and other countries. This is bound to affect the competitiveness of export products and increase the risk of intellectual property infringement. Domestic related enterprises should strengthen cooperation with high-level universities and scientific research institutes at home and abroad, actively establish innovation alliance, improve product level and added value, and form patent technology advantages. We should focus on the patents of Chinese herbal extracts from Japan, South Korea, the United States and other countries, and realize technological innovation on the basis of tracking, introducing and digesting technologies in related fields.

2. Traditional Chinese medicine industry needs to be transformed

As an emerging independent industry, the enterprises in the field of traditional Chinese medicine extract should extend the industrial chain, face the basins of plant medicine, health food, biological pesticides and plant derived veterinary drugs, and face the biotechnology transformation of traditional medicinal plants, so as to improve the profit margin.

3. Patent risk in overseas market

Many foreign markets are litigious. Before the products of Chinese enterprises are sold to the United States and other foreign markets, we should strengthen the patent distribution in the sales market. In addition to tracking the patents of large enterprises, we should pay more attention to the patent distribution trend of small and medium-sized enterprises with strong patent strength in this field and establish a sound emergency plan. At the same time, the state should guide the industry associations to establish an early warning service system for industrial patents.
